Terms and Conditions

  1. Introduction: These terms and conditions govern your use of our website and the services we provide. By using our website, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of them, you must not use our website or the services we provide.

  2. Registration: In order to access certain services on our website, you may be required to register and provide certain information about yourself. You agree to provide accurate and complete information when registering, and to promptly update your registration information as necessary to keep it current.

  3. Fees: Some services provided on our website may be subject to fees. You agree to pay all fees associated with the services you use, as they become due.

  4. Intellectual Property: The content on our website, including but not limited to text, graphics, logos, images, and software, is protected by copyright, trademark and other intellectual property laws. You may not use any of the content on our website without the express written permission of the copyright holder.

  5. Refund Policy: In order to ensure that the day runs as effectively as possible for exam candidates, refunds will only be offered if the participant cancels up to two weeks prior to the selected course date. After this, refunds will be contingent on the availability of another participant taking that position. Refunds provided will be minus the transaction processing fee. 

  6. Affiliation: This course is not officially affiliated with the Australasian Royal College of Physicians or Bond University.

  7. Course Change or Cancellation: In the event that the course is changed or cancelled for any reason, we will seek to find another day or venue. Participants will be offered the opportunity to reattend the course on the alternate day/venue or offered a refund.

  8. Non-Dissemination of Course Material: Participants agree not to disseminate any course material provided without permission from Pass the Clinical Pty Ltd prior.

  9. Patient Confidentiality: Participants agree to respect patient confidentiality and will not divulge patient sensitive information outside of the course. Pass the Clinical Pty Ltd will not hold any legal liability should this be the case.

  10. Patient/Examiner Availability: Pass the Clinical Pty Ltd makes every effort to provide a sufficient number of patients and a diverse patient pathology mix for participants to engage with, as well as a variety of examiner types. However, due to the nature of medical practice and the unpredictability of patient conditions and examiner availability, Pass the Clinical Pty Ltd cannot guarantee that participants will see a specific number of patients or a specific patient pathology mix, nor can we guarantee the presence of a specific examiner type. Pass the Clinical Pty Ltd will not be held liable for any failure to meet these expectations.

  11. Termination: We reserve the right to terminate your use of our website and services at any time, for any reason, and without notice.

  12. Failure to Attend: If a participant fails to attend on the day of the course, no refund will be provided.

  13. No Guarantee: Pass the Clinical Pty Ltd cannot guarantee that completion of the course will result in a successful outcome in the FRACP Clinical exam. The course materials and services provided by Pass the Clinical Pty Ltd are intended to serve as a supplementary resource for exam preparation and should not be considered as a sole means of exam preparation or a guarantee of exam success. Pass the Clinical Pty Ltd will not be held liable for any failure to pass the FRACP Clinical exam as a result of participating in the course.

  14. Limitation of Liability: To the extent permitted by law, Pass the Clinical Pty Ltd shall not be liable for any damages whatsoever, including but not limited to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of Pass the Clinical Pty Ltd’s website or services. This limitation applies to all causes of action, whether based on contract, warranty, tort, or any other legal theories. In the event that the course is cancelled or postponed for any reason, Pass the Clinical Pty Ltd will not be responsible for any additional costs incurred by the participant, such as but not limited to, accommodation, travel or any other expenses. The participant agrees to hold Pass the Clinical Pty Ltd harmless from any such costs.

  15. Use of Candidates' Pictures and Videos: By participating in our services, candidates grant the Company the irrevocable right and permission to use, reproduce, distribute, and display their pictures and videos captured during the course of the service delivery for promotional and informational purposes on its website, social media platforms, marketing materials, and any other promotional materials deemed necessary by the Company.

  16. Modifications: Pass the Clinical Pty Ltd reserves the right to make changes to these terms and conditions and privacy policy at any time. Your continued use of the website and services following the posting of changes to these terms and conditions and privacy policy will constitute your acceptance of such changes.

  17. 7-day Money Back Guarantee: In the event that a participant finds the course unsatisfactory subsequent to attendance, a 7-day money-back guarantee is extended. This guarantee does not apply if the participant fails to attend the designated course day, irrespective of rationale, or if the participant has previously attended Pass the Clinical events. To avail themselves of this guarantee, participants are required to furnish a written statement within 7 days post-completion of the course day (commencing on the first day of the course), elucidating the reasons for their dissatisfaction. This statement shall consist of a minimum 2-page summary delineating the participant's discontent with the course, specifying perceived inadequacies, delineating key incidents contributing to this assessment, and proffering recommendations for course enhancement to meet expectations. Provided a comparison to another course has been made, the requester must substantiate their claim with proof of purchase/attendance at said course, and articulate a comparative analysis illustrating the superior nature of the referenced course. Requests for refunds must be formally submitted in writing to passtheclinical@gmail.com within the stipulated 7-day timeframe. Refunds shall be disbursed within 30 days subsequent to the receipt of the refund request. Participants shall not bear responsibility for any disbursements made by Pass the Clinical Pty Ltd or third parties. The refund shall be exclusively directed towards the course fee, exclusive of the non-refundable transaction fee and essential organizational expenses, encompassing but not limited to catering, staffing, and logistical arrangements. Pass the Clinical Pty Ltd shall not assume liability for any ancillary expenses incurred in connection with course attendance, including but not limited to flights, accommodations, and ancillary travel-related expenses. It is imperative to acknowledge that while this Guarantee imposes an obligation upon Pass the Clinical Pty Ltd to evaluate refund requests, it does not entail automatic reimbursement. Discretion regarding refund determinations remains vested within Pass the Clinical Pty Ltd.
